STATEMENT OF COUNCIL PROCEEDINGS
NOVEMBER 8, 2022
The Ogden City Council met in Regular Session on November 8th, 2022, at 7:00 p.m. Mark Trueblood presided. Members present were Councilman David Ohlson, Councilman Brian Reimers and Councilwoman Lori Anderson. Councilman Jason Weber arrived at 7:15 p.m. City staff present were City Administrator Emily Clausen, City Clerk Melanie Olesen, Police Chief Mick Bailey, Sewer Superintendent Chad Thede and City Attorney Lee Johnson. Absent: Councilwoman Margaret Liston. Additional attendees present were Jim Turbes from KWBG, Steve Soupir of FOX-Strand and 30 guests.
Anderson made a motion, Reimers seconded to approve the agenda as presented.

Department reports were presented.
Mayor Mark Trueblood asked if there were any questions or items to be removed from the Consent Agenda. Ohlson made a motion, Anderson seconded to approve the following items on the Consent Agenda: 1) Regular meeting minutes of Tuesday, October 11th, 2022. 2) Treasurer’s Report for October 2022. 3) Claims list from October 8th, 2022 through November 4th, 2022. 4) Alcohol license for New Moon Mercantile Gifts and Décor. 5) Building permit for a 12×24 garage at 220 NE 3rd St., building permit for new home construction at 301 W. Cherry St., a fence permit for 708 W. Division St., a building permit for a 22×24 garage at 219 W. Division St., a fence permit for 208 E. Sycamore St., a fence permit for 513 W. Maple St. 7) Resolution #202211-550 – “A resolution to approve interfund transfers,” Resolution #202211-551 – “A resolution accepting the 2021-2022 Annual Finance Report,” and Resolution #202211-552 – “A resolution to approve the 2021-2022 Street Finance Report.” 8) Tax abatement application for residential rehab at 219 W. Chad Thede updated the council on the N. 1st Street project. The city had received a total of four bids for the North 1st Street Storm and Sanitary Improvements Project bid opening on November 1st, 2022. The low bid for the project was Iowa Pipe & Grading LLC with a bid of $189,195.70. Other bids received were from Keller Excavating $210,732; On Track Construction $222,480 and J&K Contracting $273,337. Motion by Reimers, second by Ohlson to approve Resolution #202211-553 awarding the N. 1st Street Storm and Sanitary Improvements Project to Iowa Pipe & Grading LLC.

All Iowa Homes representative Sherry Abbott has presented a preliminary plat for single family homes in a new subdivision in Chalberg’s 1st addition and W. Farley addition to the City of Ogden. (This is the old Howe School building site). The entire city is zoned as a restricted residence other than the downtown business district. A multi-family dwelling would need a variance prior to construction. Motion by Ohlson, seconded by Anderson to approve the preliminary plat for All Iowa Homes.

Mayor Trueblood spoke to those present that they would be allowed 2 minutes to speak. There will be no foul language and all will have a chance to voice your concerns. If the meeting gets out of hand then he will adjourn. Kari Sanculi presented the council with a petition in support of backyard chickens. Fourteen individuals spoke to the council about their opinions for or against allowing chickens in the city limits. Some presented information to the council supporting their reasons why they should be allowed chickens. The city has had complaints about chickens within the city limits. The current city code does not allow livestock within the city limits. The definition of livestock in the Ogden city code includes poultry. Motion by Weber, seconded by Anderson to enforce the current city code and allow those who have chickens six months to remove them from the city limits.

Council comments: Jason Weber has concerns about people not calling in locates before digging. If you are planning to do any type of digging please contact 811 Iowa One Call to have utilities marked. This is a free service and can be done online. Lori Anderson would like some educational information on recycling when the new building is ready.
