STATEMENT OF COUNCIL PROCEEDINGS

July 13th, 2021

The Ogden City Council met in Regular Session on Tuesday, July 13th, 2021 at 7:00 p.m. electronically via conference call at the following phone number: 978-990-5000, access code 413743 and was available to the public to attend in person. This meeting was conducted electronically due to federal and state government recommendations in response to COVID-19 pandemic conditions, pursuant to Governor Reynolds’ Proclamation of Disaster Emergency dated March 19, 2020. Mayor Denny Good presided. Members present were Councilman Jason Weber, Councilman Brian Reimers, Councilman David Ohlson, Councilwoman Lori Anderson and Councilwoman Margaret Liston. City staff present were City Administrator Emily Clausen, City Clerk Melanie Olesen and Police Chief Mick Bailey. Additional attendees present were 11 guests.

 

Anderson made a motion, Liston seconded to approve the agenda as presented.

Department reports were presented. The 1994 GMC fire truck has been sold. Only one offer was received. With the recent hailstorm, the City had three vehicles damaged and roofs, gutters and fascia. The annual audit will begin next week. Dan wanted noted there are 44 +/- ash trees that will need removed at some point. He plans to begin having some removed now.

 

Mayor Good asked if there were any questions or items to be removed from the Consent Agenda. Administrator made note to remove the license for Garbage Guys of Cambridge. We did not receive information from them. Weber made a motion, Ohlson seconded to approve the following items on the Consent Agenda: 1) Regular meeting minutes of Tuesday, June 8th, 2021. 2) Treasurer’s Report for June 2021. 3) Claims List from June 5th, 2021 through July 9th, 2021. 4) Alcohol Permit for Dollar General. 5) Fence Permits for a privacy/chain link fence for John and Megan Valen at 507 S. First Street, a 4’ wood/metal fence for Bridget Biersner at 101 W. Sycamore Street, and a wood and chain link fence for  Mark and JaNan Swanson at 101 E. Elm Street. 6) Resolution No. 202107-517 – “A Resolution to approve a total of $40.00 for special assessment to responsible property in Ogden, Iowa.” 7) Approve Houston and Seeman RFP for 2021-2022-2023 annual audits. 8) Approve Kara Kruse as the new library assistant.

With the new Boone County Flood Insurance Rate Maps (FIRMS) finalized and becoming effective October 21, 2021 our ordinance needed to be updated to make sure we are fully compliant with the regulations of the National Flood Insurance Program. Motion by Anderson, second by Liston to approve the first reading of Ordinance No. 266 amending provisions pertaining to floodplain management.

Public Hearing – 7:15 p.m. Mayor Good asked those present if the public hearing could begin a few minutes early. There were no objections. Therefore, Mayor Good closed the regular meeting at 7:09 p.m. to open the public hearing to consider approving the Real Estate Gift Agreement with Ogden Community School District.

 

Council discussed what area was in the agreement. School officials and some council walked the property earlier this year with Dave Anthoney. The legal description was provided. No other comments.

 

Mayor Good closed the public hearing and entered back into regular session at 7:12 p.m.

 

Motion by Anderson, second by Weber to approve Resolution No. 202107-516 “A Resolution approving the Real Estate Gift Agreement with Ogden Community School District.

Public Hearing – 7:20 p.m. Mayor Good asked those present if the public hearing could begin a few minutes early. There were no objections. Therefore, Mayor Good closed the regular meeting at 7:13 p.m. to open the public hearing to consider approving the usage variance at 119 SW Second Street for Future Bulldogs Childcare to be operated out of Immanuel Lutheran Church by Alexa Peterson.

 

Lexi Peterson spoke about the program. It will be a licensed facility with up to 36 infant- to preschool aged children. She has some staff lined up. They will be open Monday through Friday from 6:30 a.m. to 5:30 p.m. The tentative opening date is August 23. There was some discussion on outside playground equipment and other supply needs.

 

Mayor Good closed the public hearing and entered back into regular session at 7:20 p.m.

 

Motion by Liston, second by Anderson to approve the usage variance at 119 SW Second Street for Future Bulldogs Childcare to be operated out of Immanuel Lutheran Church by Alexa Peterson.

Public Hearing – 7:25 p.m. Mayor Good asked those present if the public hearing could begin a few minutes early. There were no objections. Therefore, Mayor Good closed the regular meeting at 7:22 p.m. to open the public hearing to consider approving a usage variance at 601 W. Cherry and 602 W. Cherry Streets from Restricted Residence to Multi-Residential and to approve a mobile home park permit for the above-mentioned properties to Ogden Iowa MHP, LLC if the parcels are owned by Ogden Iowa MHP, LLC.

 

Mark Tanner the new owner of the mobile home park spoke to council and those present at the meeting about his desire to purchase 601 and 602 W. Cherry Street properties. He would then like to add more mobile homes to those two properties. Currently, he is not under any contract with the owners. He wanted to get council approval before he would purchase these properties. If this is something that was completely not acceptable then he would not proceed with his plans. His plans are to make this a better community for everyone. He has dumpsters out now, has tree work underway and will hold people accountable for their lots. He plans to bring in newer homes. Ron Bittle then spoke his thoughts on those two properties. He has nothing positive to say about either. He also noted he has lived here for 45 years and the city is letting the town go to hell. He does not like the two migrant worker trailers and believes the other home is in horrible condition with a huge tree that is a hazard to the area. Amy Crane says there is improvements being made now but questioned what will this look like in a few years? Cranes’ would rather look at the one dilapidated home than more trailer homes. Councilmember Jason Weber has reservations about the plans as the owner does not live here in town and doesn’t have to see this on a daily basis. Ron thinks we should just be able to get people out of these derelict homes and burn them down. Councilmember Brian Reimers felt at this time due to the lack of signatures from surrounding home owners approving of this he could not agree to allow the variance. After much discussion there was some talk about compromising on the number of homes, etc. Council suggests Mark Tanner continue on with his plans of cleaning up his mobile home park and showing his good faith will continue on. If he is able to negotiate a deal with either property owners he could bring this back to council. Councilmember Lori Anderson noted that the council does care about Ogden and has concerns with derelict properties. It’s a difficult process to get properties cleaned up and takes time. Carson Crane attended this meeting as part of his Eagle Scout requirement.

 

Mayor Good closed the public hearing and entered back into regular session at 7:58 p.m.

 

Motion by Reimers, second by Weber to deny a usage variance at 601 W. Cherry and 602 W. Cherry Streets from Restricted Residence to Multi-Residential and to deny a mobile home park permit for the above-mentioned properties to Ogden Iowa MHP, LLC if the parcels are owned by Ogden Iowa MHP, LLC.

Cristina Kuhn from Dorsey and Whitney and Rick Colby from Eastern Star were present to answer any questions regarding the request to issue bonds. Councilmembers asked questions about the process and liability. Councilmember Dave Ohlson is concerned about the city being responsible for repayment if Eastern Star should default on the note. This agreement does not hold us accountable for any of the funds. The City has a bond attorney, Ahlers and Cooney, representing us to make certain that this agreement is done according to the law. Motion by Liston, second by Anderson to approve Resolution No. 202107-518 – “A Resolution authorizing the execution of a memorandum of agreement with Eastern Star Masonic Home and fixing a date for a hearing on August 10th at 7:15 p.m. on the proposed issuance of revenue bonds or notes.

Mayor’s Comments – Mayor Good appreciates all the information and the comments presented. He feels this is the place to have these differing opinions and discussions. He thanked all parties for coming to the meeting and Carson Crane for being present as well. He encouraged Mark Tanner to move forward with improving the mobile home park and that people will take notice. The City can now move forward with OMU on new water lines at the ballfields.

 

Councilmember Comments – Dave Ohlson noticed the ballfields look good. Fields are maintained nicely and the grounds. He also updated council on the Boone County Trails. They are on their way to getting phase one done. This will create a trail from the high trestle trail to Swede Point Park. Eventually, the goal is to end in Boone. Margaret says the garden was not too damaged from the storm and some harvesting has begun. Spread the word to those that may want fresh vegetables. The garden may need moved in the future but she has a plan for it. It was noted that the citizens of Ogden are happy to have the burn pile opened for more storm damaged trees. This will not be open for long so people are advised to get their tree debris there now. The City will not be picking up from the curb. Dave Huntley gave the City an A for the burn pile and an F for fireworks. He is unhappy with the amount of fireworks being shot off and that we did not put anything in the paper about our code on fireworks.

 

Public Comment – Administrator Clausen stated to be careful with all of the individuals/businesses soliciting for work due to the hailstorm. Any individual/business going door to door are required to have a solicitor permit with the City. They should have that permit with them at all times. There are many out of town and out of state businesses out and about.

 

Motion by Weber, second by Liston to adjourn at 8:45 p.m.
