STATEMENT OF COUNCIL PROCEEDINGS
May 11th, 2021
The Ogden City Council met in Regular Session on Tuesday, May 11th, 2021 at 7:00 p.m. electronically via conference call at the following phone number: 978-990-5000, access code 413743 and was available to the public to attend in person. This meeting was conducted electronically due to federal and state government recommendations in response to COVID-19 pandemic conditions, pursuant to Governor Reynolds’ Proclamation of Disaster Emergency dated March 19, 2020. Mayor Denny Good presided. Members present were Councilman Jason Weber, Councilman Brian Reimers, Councilwoman Lori Anderson and Councilwoman Margaret Liston. Absent: Councilman David Ohlson. City staff present were City Administrator Emily Clausen, City Clerk Melanie Olesen, Police Chief Mick Bailey, Library Director Lori Reutter and City Attorney Lee Johnson. Additional attendees present were 3 guests.
Liston made a motion, Anderson seconded to approve the agenda as presented.

Department reports were presented. Police Chief Mick Bailey reported he is working on multiple properties to get cleaned up. Weber asked about a property on NW 7th Street regarding mowing and music. The owner has been mowing but mows around several flower patches.
Mayor Good asked if there were any questions or items to be removed from the Consent Agenda. Reimers made a motion, Liston seconded to approve the following items on the Consent Agenda: 1) Regular meeting minutes of Tuesday, April 13th, 2021. 2) Treasurer’s Report for April 2021. 3) Claims List from April 10th, 2021 through May 7th, 2021. 4) Alcohol Permit for the Ogden Men’s Club. 5) Cigarette/Tobacco Permit for Casey’s General Store. 6) Building Permits for a garage and breezeway for Dennis and Kathy Weber at 608 W. Division Street, a gazebo for AshLea and Jason Stauffer at 620 W. Division Street and a 16×24 enclosed porch for Phillip and Belinda Davidson at 701 W. Elm Street. 7) Resolution No. 202105-514 – “A Resolution Finally Adopting the Proposed Plan for the 2021 Ogden Urban Revitalization Area.”

Tree Permit – A tree permit was received for 620 NW Sixth Street after the property owner was sent a letter informing them that they were in violation of the city tree ordinance. They planted twelve cedar trees in the city right of way without first obtaining a permit and following city code. Our code prohibits this kind of tree and does not allow the setbacks utilized. After much discussion, Councilmember Weber made a motion to approve the tree permit for 620 NW 6th Street. Due to lack of a second, the motion failed. Council informed Administrator to follow the city code and permit process.
Motion by Reimers, second by Anderson to approve the first reading of Ordinance No. 265 Designating an Area of Ogden, Iowa, as the 2021 Ogden Urban Revitalization Area.

Public Hearing. Mayor Good closed the regular meeting at 7:21 p.m. to open the public hearing on the Budget Amendment for Fiscal Year 2020/2021. No comments.
Mayor Good closed the public hearing and entered back into regular session at 7:22 p.m.
Motion by Anderson, second by Weber to approve Resolution No. 202105-513 “A resolution to approve the Budget Amendment for Fiscal Year 2020/2021 as published.”

Erich Kretzinger presented information on the Boone County Communications Center joint funding proposal from the Board of Supervisors. The current 28E agreement was created in 2005 and needs updated to reflect the current needs of the communications center funding. A proposal has been put together with approval of the Board of Supervisors. After much discussion the Ogden council believes the proposal to be a fair and equitable figure.
Mayor’s Comments – Mayor Good made note the ballfields at Howe are cleaned up and games are going on. The property is in the process of being transferred to the City by the Ogden School District. We are maintaining the grounds.
Councilmember Comments – Margaret updated council on the community garden. It has been tilled and will planted soon. Brian has concerns about some nuisance properties in town that are not being cleaned up. Ysker is operating a business in a residential area without a permit and is in violation of our code. Lee Johnson working on these properties and will find an alternate representative for the City. There are at least six properties that are continuously in violation of our code.
Public Comment – Police Chief Bailey asked about the city park light poles. They are really faded. There was some discussion on what we can do. Clausen to check with OMU on options. Weber asked Kretzinger about the county’s code on dilapidated homes in the county. They do have codes and are enforceable by complaint. Erich explained the process. Mike Salati is head of health and sanitation and could be contacted as well. The BOS are also working on an updated comprehensive plan. Erich also noted the Boone County Maintenance Shed will stay in Ogden. Administrator spoke to council about a possible vehicle charging station at 101 E. Walnut with OMU. Council would like to see a proposal or plan.
