STATEMENT OF COUNCIL PROCEEDINGS
OCTOBER 10, 2017
The Ogden City Council met in Regular Session on Tuesday, October 10, 2017 at 7:00 p.m. in the City Hall Council Chambers. Mayor Denny Good presided. Members present were Councilman Dave Ohlson, Councilman Sean Thompson, Councilman Brian Reimers, Councilwoman Lori Anderson and Councilwoman Margaret Liston. City staff present were City Administrator Emily Clausen, City Clerk Melanie Elbert, Sewer Superintendent Chad Thede, Street Superintendent Dan Buzzell and Library Director Lori Reutter. Additional attendees present were Lance Aldrich from Fox Engineering and 14 guests.
Anderson made a motion, Liston seconded, to approve the Regular Meeting minutes of Tuesday, September 12, 2017.

Approved permits were presented to the council for review. There were two permits approved in the month of September. One for a chain link fence (Jayson Pendarvis) and one for a lean to on a garage (Phil and Belinda Davidson).
Department Reports were presented. Chad updated those present that all of the tanker trucks receiving water from Ogden recently are with Northern Natural Gas Company. They are using the water to test the new lines. The sewer department will be taking the water back from them as well. Lori Reutter reported the library has hired a part time assistant to replace Karen Brandt. Melanie informed council that City Hall offices will be closed October 18-20 for conferences. Melanie also asked who could attend the Boone County League of Cities meeting next Tuesday, October 17 hosted by Ogden. Denny asked for the council’s opinion on Waters Edge parking a semi-trailer on Main Street for a few days to take items for hurricane relief. The councilmembers seen no concerns with that.
Public comment. Pat Baker of Public Works Constructors wanted to be sure the council all received his email regarding some derogatory remarks made that he responded to. None of the council nor the Mayor have seen any of the emails regarding the sewer treatment plant. Lee Johnson reported that only himself and the clerks have seen any emails and that he did see Pat’s email. Lori Anderson updated the council on the new signs Ogden Legacy is putting up. Dan will help put up the south sign and help remove the west sign on highway 30. They are taking the highway 30 sign down to refurbish it and then put it back up. OMU provided LED lighting. They are looking at some solar lighting for the East sign. Legacy received $15,000 from L.A. Good Trust for the signs.
Mayor Good closed the regular meeting at 7:12 pm to open the public hearing to review an application for a State Revolving Fund loan and to make available to the public the contents of an environmental information document and the City’s project plan. Lance Aldrich from Fox Engineering reviewed the proposed improvements to the City’s wastewater treatment facility and the design and environmental information related to this project. There were no public comments or concerns. The clerk had not received any comments prior to the public hearing.
Mayor Good closed the public hearing and entered back into regular session at 7:17 pm.
Mayor Good closed the regular meeting at 7:18 pm to open the public hearing on the hearing and invitation to bid for WWTF activated sludge upgrades. Lance Aldrich, Fox Engineering, went over the plans for the waste water treatment plant. He informed those present that sealed proposals were received until 10 am on October 6 for the project. There were no questions or comments presented.
Mayor Good closed the public hearing and entered back into regular session at 7:21 pm.
Award Contract for construction of Wastewater Treatment Activated Sludge Upgrade. Lance Aldrich, Fox Engineering, gave updates on bids. There were four bids received ranging from $5,052,000 to $7,500,000. The Engineer’s opinion of probable construction cost was $4,900,000. He noted that the low base bids were only a $3000 difference and with the two bid alternates there is only a $600 difference. Lance gave some background information on Public Work Constructors (PWC) of Venice, Florida. They are an LLC affiliated with Weiss Construction located in Detroit, MI. This is not a firm that Fox is familiar with nor are they aware of any work completed in Iowa by either firm. PWC has done work in VT, GA, and TX on treatment plant projects. They have been awarded 3 projects in Florida for 11 million dollars. Fox contacted Philip Kora, with the Great Lakes Water Authority, and he noted that Weiss has done acceptable work for at least 20 years. Pat Baker would like Fox to look at his individual references as well. This would help tell what kind of person he is. He worked for Story Construction in the 1990’s and has done work in AZ, NE and TX. Lance commented that Woodruff Construction is out of Ames and Fort Dodge. They have done a lot of treatment plant work and worked directly on many Fox projects. A representative from Woodruff noted that they are a local company. Their workers are all local and they have been in business over 60 years. They would be the low bidder if the bid alternates are added on. Lance wondered what other information he could provide on the two contractors to the City? Lance will get more information on PWC projects from Florida and check references on both companies, PWC and Woodruff. Work will more than likely begin in the spring with completion by June 2019. Chad Thede, Sewer Superintendent, wants Lance and the City to do their due diligence and make sure everything is done correctly. We have to be DNR compliant under contract by January 1st. He feels the bid alternates need to be included in the contract. The council tabled any action. A special meeting will be held on Tuesday, October 24th at 7 pm for the award of contract for construction of the wastewater treatment activated sludge upgrade. Mayor Good thanked everyone for attending and appreciated everyone’s input.
Award contract for snow removal for winter months. Action was tabled as there were no bids received.
Reimers made a motion, Ohlson seconded, to approve the second reading and waive the third and final reading of Ordinance No. 244 – An ordinance amending the code of ordinances of the City of Ogden, Iowa, 1996, by amending provision pertaining to open burning restrictions.”

It was also noted that the landfill is currently accepting yard waste now through November 30th.
Anderson made a motion, Liston seconded, to approve the second reading and waive the third and final reading of Ordinance No. 245 – An ordinance amending the code of ordinances of the City of Ogden, Iowa, 1996, by adding a new paragraph pertaining to special civil penalties for opening burning.

Thompson made a motion, Ohlson seconded, to approve the second reading and waive the third and final reading of Ordinance No. 246 – An ordinance amending the code of ordinances of the City of Ogden, Iowa, 1996, by repealing a portion of Chapter 1, Section 10 pertaining to imprisonment.
Ayes: All Present, Motion Carried.
Ohlson made a motion, Anderson seconded, to approve the second reading and waive the third and final reading of Ordinance No. 247 – An ordinance amending the code of ordinances of the City of Ogden, Iowa, 1996, by amending provisions pertaining to cigarette and tobacco permits.
Ayes: All Present, Motion Carried.
Reimers made a motion, Thompson seconded, to approve the second reading and waive the third and final reading of Ordinance No. 248 – An ordinance amending the code of ordinances of the City of Ogden, Iowa, 1996, amending provisions pertaining to all-terrain vehicles and snowmobiles.
Ayes: All Present, Motion Carried.
Anderson made a motion, Ohlson seconded, to approve the beer and liquor licenses for Clark’s Food Mart and Casey’s General Store.

Youth and Shelter Services informed the council and community members what a tremendous difference our Kids Club Before and After School Programs are making in Iowa. They are participating in the national “Lights On After School Open Houses” to help send the message that after school is key to children’s success and that we must keep after school’s lights on and doors open. Mayor Good then signed a proclamation hereby proclaiming October 26, 2017 as “Lights On After School” Day.
